This Privacy Policy provides a description of how Resources for Children with Special Needs, Inc., a 501(c)(3) non-profit, d/b/a INCLUDEnyc (“INCLUDEnyc,” “we,” “our,” or “us”) collects, uses, and shares information about you when you use our website or interact with us offline (the “Service”), as well as your rights and choices regarding such information.
By using the Service, you agree to the Privacy Policy and our Terms & Conditions (together referred to as the “Agreement”). If you do not agree and consent, discontinue use of the Service.
The Agreement governs your use of our Service and we will collect, use, and share information consistent with the Agreement.

1. Information Collection
We collect the following categories of information:
- Contact Data, including your first and last name, email address, postal address, borough, and phone number.
- Profile Data, including, but not limited to, primary language, relationship such as your status as a parent, family member, professional, or young adult.
- Donation Data, including the amount donated, desired frequency of donations, employer for corporate matched donations, honoree if the donation is made in honor of another, payment instrument number (such as a credit or debit card number), expiration date, and security code as necessary to process your donations.
- Content, including content within any messages you send to us including but not limited to through our Service, WhatsApp, by email, or text message.
- Webforms and Applications, including information provided in applications for our Services whether submitted online or via email. When you submit an application or webform, or we enroll you in our newsletter.
- Service Use Data, including data about features you use, the pages you visit, emails and content you view, the time of day you browse, and your referring and exiting pages.
- Device Data, including data about the type of device or browser you use, your device’s operating software, your internet service provider, your device’s regional and language settings, and device identifiers such as IP address.
- Non-Precise Location Data, including imprecise location data (such as location derived from an IP address or data that indicates a city or postal code level).

2. Sources
We collect information from the following sources:
- Information you provide through the Service. When you use the Service, you may be asked to provide information to us, such as when you register for an account, make a donation, sign up for our newsletters, respond to us, submit a webform, sign up for an event, or contact us. Please do not provide any information that we do not request.
- From your device. When you use the Service, we and third parties we work with automatically collect information from your browser or device using cookies and other tracking technologies. See the Cookies and Other Technologies section below.
- From third parties. We obtain information from third party sources, including:
- Third party vendors and related parties we work with in connection with receiving analytics, advertising, security, and fraud prevention services.
- Social media platforms with which you interact. For example, when you engage with our social media channels, we may collect information associated with your profile. We may also receive additional information from the social media platform that you have authorized the platform to disclose to us. If you publicly reference us, we may feature your post in our Service or marketing materials.
- Public sources, such as data in the public domain.
- Where we generate the information. We generate information based on information we collect from the various sources described above.
3. Cookies and other Technologies
- Cookies, which are small data files stored on your device which act as a unique tag to identify your browser. We use two types of cookies: session cookies and persistent cookies. Session cookies make it easier for you to navigate our website and expire when you close your browser. Persistent cookies help with personalizing your experience, remembering your preferences, and supporting security features. Additionally, persistent cookies allow us to bring you advertising both on and off the Service. Persistent cookies may remain on your device for extended periods of time, and generally may be controlled through your browser settings.
- Pixels. Pixels (also known as web beacons) are pieces of code embedded in a service. 4. Use of Information
We collect and use information in order to:
- Operate and manage our Service, including providing resources, disability news and events for parents and education professionals.
- Perform services requested by you, such as respond to your comments, questions, and requests, and provide client intake.
- Send you technical notices, updates, security alerts, information regarding changes to our policies, and support and administrative messages.
- Prevent and address fraud, breach of policies or terms, and threats or harm.
- Monitor and analyze trends, usage, and activities.
- Conduct research, including focus groups and surveys.
- Improve the Service or our websites, marketing efforts, or services.
- Develop and send you direct marketing, including reaching out to donors about events and opportunities to donate, and communications about our and other entities’ events and services.
Notwithstanding the above, we may use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law. 5. Disclosure of Information
We disclose the information we collect in accordance with the practices described in this Privacy Policy. The types of entities to which we disclose information includes:
- Service Providers. We disclose information to entities that process information on our behalf. Service providers assist us with services such as payment processing, data analytics, marketing and advertising, website hosting, and technical support. We may permit them to use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law.
- Partners. We disclose information to our partners in connection with offering co-branded events, resources and services, or engaging in joint marketing activities.
- Merger or Acquisition. We disclose information in connection with, or during negotiations of, any proposed or actual merger, purchase, sale or any other type of acquisition or business combination of all or any portion of our assets, or transfer of all or a portion of our Service to another entity.
- Security and Compelled Disclosure. We may disclose information to comply with the law or other legal process.
- Facilitating Requests. We disclose information at your request or direction, such as when you choose to disclose information with a social network about your activities through the Service.
- Consent. We otherwise disclose information with notice to you and your consent, including in disclosing information provided in a Webform or Application for services.
Notwithstanding the above, we may disclose information that does not identify you (including information that has been aggregated or de-identified) except as prohibited by applicable law. We do not sell your personal information or share it with third parties for advertising purposes. 6. Third Parties
Our Service may link to or be incorporated with websites and online services controlled by third parties. We may integrate technologies into our Service, including those described in the Cookies and Other Technologies section, that are controlled by third parties. Except where third parties act as our service providers, they (not us) determine the purposes and means of processing your information.

B. Browser and Device Controls
- Cookies and Pixels. Most browsers accept cookies by default. You can instruct your browser by changing its settings to decline or delete cookies. If you use multiple browsers on your device, you will need to instruct each browser separately. Your ability to limit cookies is subject to your browser settings and limitations.
- Do Not Track. We do not respond to Do Not Track signals
- Third party opt-out tools. Some third parties we work with offer their own opt-out tools related to information collected through cookies and pixels. To opt out of your information being used by Google Analytics, visit https://tools.google.com/dlpage/gaoptout. We are not responsible for the effectiveness of their tools.
- Industry opt-out tools for targeted advertising. Some third parties we work with follow the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising, which offers its own opt-outs tools for targeted advertising. For details, visit https://youradchoices.com/control. We are not responsible for the effectiveness of these tools.
C. Communications
- E-mails. You can opt-out of receiving promotional emails from us at any time by following the instructions as provided in emails to click on the unsubscribe link, or emailing us at the email address set out in the “Contact Us” section below with the word UNSUBSCRIBE in the subject field of the email. Please note that you cannot opt-out of non-promotional emails, such as those about your donations, registration to events, workshops, or INCLUDEnyc’s ongoing relationship with you.
- Text Messages and Calls. You can opt-out of receiving text messages or calls to your phone number at any time by texting “STOP” in response to any text message you receive from us or contacting us as set out in the “Contact Us” section below and specifying you want to opt-out of text messages.
Please note that your opt out is limited to the email address, device, and phone number used and will not affect additional or subsequent subscriptions.
8. Children
The Service is not directed toward children under 16 years old. If you are a parent or guardian and believe we have collected information from children in violation of applicable law, contact us as set out in the Contact Us section above.
9. Data Security
We implement and maintain reasonable administrative, physical, and technical security safeguards to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. Nevertheless, transmission via the internet is not completely secure and we cannot guarantee the security of information about you.
10. International Transfer
We are based in the U.S. and the information we collect is governed by U.S. law. If you are accessing the Service from outside of the U.S., please be aware that the information collected through the Service may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Data protection laws in the U.S. and other jurisdictions may be different from those of your country of residence. Your use of the Service or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of information about you in the U.S. and other jurisdictions as set out in this Privacy Policy.
11. U.S. State-Specific Disclosures.
This section applies to residents of Colorado, Delaware, Maryland, Minnesota, New Jersey, and Oregon. This section does not apply to residents of other states except as expressly provided herein.

Our data practices are as follows:
- Collection. In the past 12 months, we have collected the categories of personal information set out in the Information Collection section above.
- Sources. The categories of sources from which we collect personal information are set out in the Sources section above
- Purpose. The specific purposes (including business and commercial purposes) for collecting and using personal information are set out in the Use of Information section above.
- Disclosure. The categories of persons to whom personal information is disclosed, including service providers for business purposes, are set out in the Disclosure of Information section above. We disclose the categories of personal information listed in the Information Collection section above to service providers for business purposes.
- Sales, Shares, and Targeted Advertising. We do not sell or share personal information for cross-context behavioral advertising purposes under applicable law. We do not process your personal information for purposes of targeted advertising as defined by applicable law. We do not sell or share the personal information of consumers we know are under 16 years old.
- Profiling. We do not process personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers.
- Sensitive Data. We collect, use, and disclose sensitive personal information only for the permissible business purposes for sensitive personal information under applicable law. We do not sell or share sensitive personal information to third parties.
- Retention. We retain information for the length of time that is reasonably necessary for the purpose for which it was collected, and as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements.
Rights

- Verifiable Requests. You have the right to:
- Confirm whether or not we are processing your personal information, and in some regions, confirm the categories of personal information we have processed;
- Access your personal information;
- Correct inaccuracies in your personal information;
- Delete your personal information;
- Obtain a copy of your personal information that you previously provided to us in a portable and readily usable format
If you are a Minnesota or Oregon resident, you also have the right to obtain a list of the specific third parties to which we have disclosed personal data.
If you are a Delaware or Maryland resident, you also have the right to obtain a list of categories of third parties to which we have disclosed your personal data.
- Revocation of Consent. You have the right to revoke consent previously given to us that we rely on to process your personal information. If you withdraw consent, you may not be able to receive certain services dependent on that consent.
- Nondiscrimination. You have the right not to be discriminated against for exercising any of your rights.
- Appeals. You have the right to appeal our decision in response to your requests.
- Authorized Agents. You may exercise your rights through an authorized agent.
Exercising Rights
This section sets out how to exercise your rights.
- Verifiable Requests. Verifiable requests require us to verify your identity before fulfilling them. To exercise any of these rights, submit a request by emailing us as set out in the Contact Us section above. We will confirm receipt of and respond to your request consistent with applicable law. To verify your identity, we may require you to confirm receipt of an email sent to an email address that matches our records, provide us with details relating to your history with us, or provide additional information. If we cannot verify your identity, we may deny your request in accordance with applicable law.
- Consent. To revoke consent, write us at the email or postal address set out in the Contact Us section above (specifying the consent you wish to withdraw). If you withdraw consent, you may not be able to receive certain services related to that consent.
- Authorized Agents. Authorized agents must submit requests through the specific methods designated herein. Except where prohibited by law, we will require written and signed proof of the agent’s permission.
- Appeals. To appeal, write us at the email or postal address set out in the Contact Us section above and specify what you wish to appeal. We will review and respond to your appeal in accordance with applicable law. If we deny your appeal, you may submit a complaint to your Attorney General as follows: Colorado, Delaware, Maryland, Minnesota, New Jersey, Oregon.
- Limitations. Your rights are subject to exceptions and our data retention practices. To the extent permitted by law, rights requests must be exercised through the applicable designated method specified herein
12. Changes to this Privacy Policy
We reserve the right to revise and reissue this Privacy Policy at any time. Any changes will be effective immediately upon posting of the revised Privacy Policy in connection with our Service.
